USCIS ANNOUNCES NEW FILING OPTIONS FOR CANADIAN APPLICANTS SEEKING TN CLASSIFICATION

The TN is a work permit that allows Canadian citizens to legally work in the United States for a US employer or client. Canadian citizens are eligible for a TN work permit if they will be entering the US to work in a profession that is listed in Appendix 1603.D.1 of the North American Free Trade Agreement (NAFTA), and meet the experience and/or educational requirements for the profession per NAFTA requirements.

In the past, for a Canadian citizen to obtain a TN, the applicant would need to present their application to a US Customs and Border Protection Officer at a port-of-entry (i.e. a US/Canada land-border crossing) or at a pre-flight inspection point within a Canadian international airport. However, the US Citizenship and Immigration Services (USCIS) has recently begun accepting Form I-129, Petition for Nonimmigrant Worker, filed on behalf of Canadian citizens outside the United States who seek classification as TN. What this means is that rather than applying for a TN in person at a port-of-entry or an airport, Canadians can apply for TN status by mailing or couriering their application to a USCIS Service Center in the United States and receive a decision on the application from the USCIS by mail. The current processing time for TN petitions filed with the USCIS is approximately two months.
